2. Information Usage: Your data is used to deliver and improve healthcare services, process appointments and payments, facilitate provider consultations, send care reminders, and communicate health information you have requested.

3. Third-Party Sharing: We never sell your health data. We may share with treating physicians, insurance carriers for claims, laboratory partners, pharmacy networks, and legal authorities when mandated by law.

4. Data Encryption: Patient data is encrypted with AES-256 at rest and TLS 1.3 in transit. We maintain SOC 2 Type II compliance and undergo annual third-party security audits.

5. HIPAA Compliance: Optimal Health Span fully complies with HIPAA, maintaining administrative, physical, and technical safeguards for Protected Health Information under 45 CFR Parts 160 and 164.

6. Patient Rights: You have the right to access records, request amendments, receive disclosure accounting, request use restrictions, and receive confidential communications through alternative means.

7. Data Retention: Medical records are retained for seven years minimum per federal and state law. Insurance records are kept for ten years. You may request earlier deletion of non-mandatory data.

8. Cookie Policy: We use essential cookies for functionality and analytics cookies for improvement. No third-party advertising cookies. You may disable non-essential cookies in your browser.

9. Telehealth Privacy: Video consultations use end-to-end encrypted connections. Sessions are never recorded without explicit written patient consent. Provider notes are stored in our secure EHR system.

10. Minor Privacy: Parental or guardian consent is required before collecting data from patients under 18. Parents may access and control their child's health information per applicable state laws.

11. Marketing Communications: With consent, we may send promotional emails about services and wellness tips. Every marketing email includes an unsubscribe link. Opting out does not affect healthcare access.

12. Third-Party Integrations: We integrate with Stripe (payments), scheduling platforms, and lab networks. Each partner is contractually bound to maintain equivalent data protection standards.

13. Breach Notification: In the event of a data breach affecting your PHI, we will notify you within 60 days per HIPAA, including the nature of the breach, types of information involved, and protective steps.

14. International Access: Services are designed for U.S. residents. If you access from outside the U.S., your data may be processed in the United States under U.S. privacy laws.

15. Right to Access: You may request a copy of all personal data we hold. Requests are processed within 30 days. Electronic copies provided at no charge.

16. Right to Correction: You may request corrections to inaccurate personal or health information. Medical record corrections follow the HIPAA amendment process.

17. Right to Deletion: You may request deletion of your account and non-essential data. Certain records must be retained per legal requirements.

18. Data Portability: You may request health data in a structured, machine-readable format for transfer to another provider following CCDS export standards.

19. No Automated Decisions: We do not use automated systems for clinical decisions. All medical decisions involve licensed professionals. Automation is limited to scheduling and verification.

20. Location Data: Our app may request location access to find nearby providers. Location data is used only for the requested service and not stored without permission.

21. Wearable Data: If you connect wearables, collected data is stored securely and used only for wellness monitoring with your explicit consent.

22. Insurance Verification: We share minimum necessary information with insurers—name, member ID, and service type only.

23. Employee Access: Only authorized employees with legitimate need may access health records. All access is logged and audited. Employees undergo annual HIPAA training.

24. De-identified Data: We may use de-identified health data for research and quality improvement following HIPAA Safe Harbor standards.

25. Policy Updates: We may update this policy periodically. Material changes communicated via email 30 days before taking effect.

1. Acceptance: By accessing Optimal Health Span's website, app, or services, you agree to these Terms. If you disagree, discontinue use immediately.

2. Service Description: Optimal Health Span provides telehealth consultations, in-person appointments, wellness programs, insurance navigation, and health services through licensed professionals.

3. Eligibility: You must be 18+ to create an account. Minors may use services only under parental/guardian consent. Services available to U.S. residents only.

4. Account Registration: You must provide accurate information and maintain the security of your credentials and all account activities.

5. Service Limitations: Optimal Health Span does not provide emergency services. For emergencies, call 911. Telehealth may not suit all conditions; providers may recommend in-person care.

6. Appointment Scheduling: Appointments subject to provider availability. We strive to honor times but may reschedule due to emergencies with prompt notification.

7. Cancellation Policy: Cancel up to 4 hours before at no charge. Late cancellations: $15 fee. No-shows charged full visit fee.

8. Pricing: All prices displayed before booking in U.S. dollars. Payment due at booking unless insurance arrangements confirmed.

9. Insurance Billing: We bill insurers directly for covered services. You are responsible for copays, deductibles, and non-covered amounts.

10. Refund Policy: Refunds available for services not rendered. Provider cancellations receive full refunds. Refund requests within 30 days.

11. Medical Disclaimer: Website information is for general purposes and does not constitute medical advice. Always consult qualified providers.

12. Provider Independence: Providers are independent contractors, not employees. We credential all providers but are not liable for clinical decisions.

13. Telehealth Consent: By scheduling video visits, you acknowledge telehealth limitations including no physical exams and potential technology failures.

14. Prescriptions: Providers may prescribe when appropriate. Controlled substances follow DEA and state laws. Prescriptions sent electronically.

15. Medical Records: You have the right to access records. Records available upon request. Transfers follow HIPAA guidelines.

16. Intellectual Property: All content owned by Optimal Health Span and protected by U.S. intellectual property laws.

17. User Content: By submitting reviews, you grant Optimal Health Span a non-exclusive, royalty-free license to use such content.

18. Prohibited Uses: No unlawful use, false information, unauthorized access, harassment, or data scraping.

19. Service Modifications: We may modify services with reasonable notice. Continued use constitutes acceptance.

20. Liability Limitation: Total liability shall not exceed the amount paid for the disputed service. No indirect or consequential damages.
